This Privacy Policy explains how we collect, use, store and disclose personal data when you use our taxi and private hire services (the "Services"), website, booking platform or communicate with us.

This Notice applies in relation to the provision of the Services and in particular to your use of, or engagement with, any or all of the following (as applicable):

  • the SIGMA CARS software application or booking platform (the “App”);
  • the SIGMA CARS website (the "Website"); and
  • any other communications (whether over telephone, email, SMS message or otherwise) between you and SIGMA CARS in connection with the provision of the Services.

This Notice sets out the basis on which any personal data we collect from you or that you provide to us, in connection with your use of the Services ("Personal Data"), will be processed by us or our third-party service providers. Please read the following carefully to understand our views and practices regarding your personal data and how we will treat it.

We may collect and process some or all of the following Personal Data about you, as applicable:

3. How and Why We Process Your Personal Data

Legal Basis: Necessary for the Performance of a Contract

It is necessary to process your Personal Data to enter into and perform our contract with you in relation to the Services. We may use your Personal Data to:

  • create and maintain your account or booking profile;
  • receive and manage bookings and communicate with you about journeys;
  • provide drivers with the information necessary to complete a journey, such as your name, contact number, pickup location and destination;
  • arrange, provide and monitor transportation;
  • process or facilitate payments and refunds;
  • provide customer service and support;
  • send service-related notifications, confirmations and updates; and
  • maintain and improve the functionality of our booking systems and Services.

Legal Basis: To Comply With a Legal Obligation

We may process your Personal Data where necessary to comply with applicable UK laws and regulatory requirements, including requirements relating to licensing, taxation, accounting, fraud prevention, safeguarding, law enforcement requests and the keeping of required business records.

Legal Basis: Legitimate Interests

It is in SIGMA CARS’s legitimate interests to process Personal Data for purposes such as:

  • operating, securing and maintaining our booking systems and IT services;
  • preventing fraud, misuse, security incidents and loss of data;
  • investigating complaints, disputes and service issues;
  • improving our Services and understanding general usage trends using appropriate safeguards; and
  • establishing, exercising or defending legal claims.

When relying on legitimate interests, we consider the potential impact on individuals and their data protection rights. You have the right to object to processing based on legitimate interests.

4. Disclosure of Your Information to Third Parties

Service Providers: We may share relevant Personal Data with service providers that support the provision of the Services, including Coolnagour Limited t/a iCabbi and other technology, hosting, communications and payment service providers used by SIGMA CARS. Such providers process data on our behalf where applicable and under appropriate contractual and security arrangements.

We do not sell identifiable passenger Personal Data to advertisers. We may use aggregated or anonymised information for service analysis and, where lawful, general marketing or advertising purposes.

We do not currently anticipate routinely sharing passenger Personal Data within a wider corporate group. If this changes, we will only do so where there is a lawful basis and appropriate safeguards.

We may disclose Personal Data where required or permitted by law, including to police, regulators, courts, local authorities or other competent public bodies.

If SIGMA CARS or substantially all of its assets are acquired or transferred, Personal Data may be transferred as part of the transaction where lawful and subject to appropriate safeguards and notice requirements.

5. Links to Third Party Websites

Our Website or booking platform may contain links to third-party websites or services. Those third parties have their own privacy policies and we are not responsible for how they process personal data. Please review their privacy notices before providing personal information to them.

6. Storing and Transfers of Your Personal Data

We may transfer your Personal Data outside the United Kingdom where this is necessary for the provision of our Services or where our service providers process data internationally. Where a restricted international transfer takes place, we will use an appropriate legal transfer mechanism and safeguards required by applicable UK data protection law.

Where such transfers occur, we will ensure that the transfer is made in accordance with applicable UK data protection law and that appropriate contractual, technical and organisational safeguards are in place.

All information you provide to us is stored on our secure servers or the servers of our service providers, contractors or suppliers. Where we have given you, or where you have chosen, a password that enables you to access the App or Website, you are responsible for keeping this password confidential. We ask you not to share a password with anyone.

7. How Long We Keep Your Personal Data For

We will keep your Personal Data only for as long as reasonably necessary for the purposes for which it was collected, including providing the Services, maintaining business and accounting records, dealing with complaints or disputes, and complying with legal and regulatory obligations.

Different types of information may be retained for different periods. When information is no longer required, we will securely delete it or anonymise it where appropriate.

Please note that in certain circumstances, we may hold your Personal Data for a longer period, for example, if we are processing an ongoing claim or believe in good faith that the law or a relevant regulator may reasonably in our view expect or require us to preserve your data.

8. Your Rights & How to Exercise Them

You have a number of rights in relation to your Personal Data. In particular, these rights include the right to object to processing of your personal data where that processing is carried out for our legitimate interests. In certain circumstances, these rights might not be absolute.

  • You may also access your personal data by logging into your account on the App or Website and viewing your profile.
Right to Rectification You have the right to request that we amend any inaccurate personal data that we have about you.
Right to Erasure

You have the right to ask us to erase your personal data where:

  1. it is no longer necessary to perform the contract;
  2. you withdraw your consent and there is no other legal basis permitting us to process your personal data;
  3. you object to the processing and we have no overriding legitimate grounds;
  4. your personal data have been unlawfully processed; or
  5. it must be erased to comply with a legal obligation.

Please note that some of your personal data may be required in order for the App to function properly.

Right to Restriction of Processing

You have the right to ask us to restrict processing your personal data in the following situations:

  1. where you contest the accuracy of your personal data;
  2. where the processing is unlawful and you do not want us to delete your personal data;
  3. where we no longer need your personal data for the purposes of processing but you require the data in relation to a legal claim;
  4. where you have objected to us processing your personal data pending verification as to whether or not our legitimate interests override your interests or in connection with legal proceedings.
  • When you exercise this right we may only store your personal data.
  • We may not further process the data unless you consent or the processing is necessary in relation to a legal claim, to protect the rights of another person or legal person, or for reasons of important public interest.
  • Please note that it may be necessary for us to process some of your personal data in order to provide the App or Website and, in certain instances where you ask us not to process your personal data, you may not be able to use the App or Website.
  • We will inform you before the processing restriction is lifted.
Right to Data Portability

You may request us to provide you with your personal data which you have given us in a structured, commonly used and machine-readable format and you may request us to transmit your personal data directly to another data controller where this is technically feasible.

This right only arises where:

  1. we process your personal data on the legal bases of your consent or where it is necessary to perform our contract with you; and
  2. the processing is carried out by automated means.
Right to Object You have a right to object at any time to the processing of your personal data where we process your personal data on the legal basis of pursuing our legitimate interests.
Right to Object to Automated Decision-Making, including Profiling
  • You have a right not to be subject to a decision based solely on automated processing, including profiling, which produces legal effects concerning you or similarly significantly affects you.
  • We may not be able to comply with this request where the processing is necessary to enter or perform our contract with you or where you explicitly consent to this. However, you are entitled to have a person from our team review the decision so that you can query it and set out your point of view to us.

9. Age and Passenger Bookings

Passengers under 18 may travel using our Services where the booking is made by an appropriate adult or otherwise in accordance with applicable booking and safeguarding requirements. We may process the personal data of passengers under 18 where this is necessary to provide the Services, meet legal obligations or protect passenger safety. We do not knowingly use children’s personal data for direct marketing without an appropriate lawful basis.

10. Changes to This Notice & Questions

We may update this Privacy Policy from time to time. Material changes will be communicated through our Website, App or other appropriate means. The updated policy will show the date on which it was last revised.

If we decide to use your Personal Data for a materially different purpose from that described in this Privacy Policy, we will provide appropriate information about the new purpose before starting that processing, where required by law.
